Military Living® User Agreement Effective August 24, 2010

Welcome to Military Living® Publications’ web site. Please read this User Agreement before you use our web site or submit content to us.

Your access to and use of our web site is subject to this User Agreement. By visiting our web site or submitting any content to us, you agree to be bound by and to comply with this User Agreement. If you do not accept this User Agreement, then please do not visit or use our web site or submit any content to us.

The Site. Our web site features information, opinions, photographs, and other content about a wide variety of topics related to travel and lodging for military service members, retired military service members, and their families. We grant you permission to use the site for your own personal, non-commercial use. We do not grant you any other rights with respect to our web site or its content. You may download, display, or print a reasonable number of copies of any portion of the content on our web site for your personal use.

Availability. We will use our reasonable efforts to keep this site available, but we may have to take this site down from time to time or limit access to all or certain portions of the site for maintenance and system outages. We do not promise that access to the site will be uninterrupted or available at all times. We will not be liable or responsible to you for any delay, interruption, or downtime.

Content. The content on our web site is intended for information purposes only. There might be errors, or the information may not be complete, current, or applicable to your particular situation. You are responsible for evaluating the accuracy, completeness, and usefulness of any opinion, advice, or other content on our web site. We will not be responsible for any liability associated with errors or omissions.

We assume no responsibility for any materials posted or submitted. We cannot promise guarantee that we will return any materials you submit. We also do not promise guarantee that your submission will be posted or published.

Privacy Policy. Your use of our web site is subject to our Privacy Policy. You agree that you have read our Privacy Policy and it is reasonable and acceptable to you. We reserve the right to store information on your computer in the form of a “cookie” or similar file for purposes of modifying the site to reflect user preferences. The Privacy Policy provides additional information about our use of cookies. You are responsible for maintaining the secrecy of your Member ID and Password. This is essential to protect the confidentiality of information that may be stored in the registration-only section of the site. You will be financially accountable for all use of the site by you or anyone else using your password and login information.

Code of Conduct. You agree to abide by the following rules of conduct:

You must be 18 years of age or older to use the site. Only those who have registered as members or users may access the registration-required portions of the site. You agree not to copy, modify, download, display, post, publish, license, create derivative works of or otherwise send our content in any form, except for your personal use. You agree not to use the site to solicit or advertise any product or activity.

You agree not to use our trademarks, trade names, logos, or other identifying information for any purpose without our written permission. You agree not to use the site for any unlawful purpose or activity including, without limitation, chain letters, junk mail, spamming, spoofing, hacking, attempting to circumvent Internet security measures, or submitting material that encourages conduct that could constitute a criminal offense, gives rise to civil liability, or violates any applicable law. You agree not to interfere with any other visitor’s use and enjoyment of the site. You agree not to submit any content that does not comply with this User Agreement. You agree to respect the opinions of other users. You agree to discuss opinions in a respectful manner.

Violations. You are responsible for complying with all the terms of this User Agreement. If you violate any of the terms of this agreement, we have the right to suspend, block, or terminate your access to our site and to pursue you for any liability or damages. If you access the site after your suspension or termination, that will constitute an act of trespass.

Links. For your convenience, we sometimes provide links to other web sites. When you click on one of those links, you are leaving our site and entering another site. We are not responsible for these other sites. You should carefully review the terms and conditions for the use of those sites, because those terms will apply to your visit. Disputes. Virginia Law without regard to its conflict of law rules will govern this Agreement. If you take any legal action relating to your use of our site or this agreement, you agree to file such action only in the State and Federal Courts located in Fairfax County, Virginia. The prevailing party in any law suit will be entitled to recover all expenses incurred in connection with the lawsuit, including, but not limited to, costs and reasonable attorney’s fees.

Changes. We may change the terms of the User Agreement from time to time by updating this web page. You should visit the User Agreement regularly to keep up to date with the current terms and conditions regarding your use of the site. We also may modify or discontinue our web site without any notice, obligation, or liability to you.

General. If we fail to act with respect to your breach or anyone else’s breach on any occasion we are not waiving our right to act with respect to future or similar breaches. If a court finds any of the terms of this User Agreement to be unenforceable or invalid that particular term will be enforced to the fullest extent permitted and the other terms will remain valid and enforceable. The terms of this User Agreement and any other terms made a part of this Agreement by reference make up the entire agreement between you and us related to your use of this site, and replaces any prior understandings or agreements (whether oral or written).

Prior Terms and Conditions. These terms supersede any prior Military Living® User Agreement relating to the use of the site that were displayed on the site before the date stated above. They do not supersede any additional terms provided elsewhere in this site.

Written Documents. You may preserve this User Agreement in written form by printing it for your records, and you waive any other requirement that this agreement be evidenced by a written agreement.

Electronic Notification. To the extent we may need to contact you, you agree that we may do so by any electronic means, including electronic mail or instant messaging.
